Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of LUXCHAT, the live chat platform operated by SEOTLUX, LLC, registered in Delaware, United States (File Number: 10100395).

By creating an account or embedding the LUXCHAT widget you agree to these Terms. If you use LUXCHAT on behalf of a company, you represent that you are authorized to bind that company.

2. Your account

You are responsible for the accuracy of the information you provide, for keeping your credentials confidential, and for all activity that occurs under your account.

You must be at least 16 years old, or the minimum age required by the law of your jurisdiction, to use the service.

3. Acceptable use

You agree not to: use the service for unlawful purposes; send spam or unsolicited messages; collect visitors' data through deceptive means; attempt to gain unauthorized access to the service or other workspaces; reverse engineer, scrape or resell the service without a written agreement; or upload malicious code.

We may suspend or terminate accounts that violate these rules.

4. The widget and your visitors

You are responsible for the lawful collection of your visitors' data through the LUXCHAT widget, including providing any notice and obtaining any consent required in your jurisdiction.

You retain ownership of the conversations and data your visitors send through the widget. We process that data only to provide the service to you.

5. Billing and plans

Paid plans are billed in advance on the interval shown at checkout. Fees are exclusive of taxes unless stated otherwise.

You may cancel at any time; cancellation stops future billing. Fees already paid are non-refundable except where required by law.

We may change pricing with reasonable advance notice; changes apply to subsequent billing periods.

6. Service availability

We work to keep LUXCHAT available, but the service is provided "as is" and "as available". We do not guarantee uninterrupted or error-free operation, and we may modify or discontinue features as the product evolves.

7. Intellectual property

LUXCHAT, the LUXCHAT name and its interface are owned by SEOTLUX, LLC. You may not copy or reuse our branding, code or design without permission.

Your content — messages, conversations, branding you upload — remains yours. You grant us the limited right to host, store and display it solely to operate the service.

8. Limitation of liability

To the maximum extent permitted by law, SEOTLUX, LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the service.

Our aggregate liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.

9. Termination

You may close your account at any time. We may suspend or terminate your access for violations of these Terms or for non-payment.

After termination, we retain your data for a short grace period to allow export, after which it is deleted.

10. Governing law and contact

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules.
